TERMS OF SERVICE AGREEMENT

This Terms of Service Agreement is entered into by:

Keziah Grace of KG Coaching (formerly KG Anxious to Sing), hereinafter referred to as the "Coach,"

AND:

You, the purchaser and/or the person using the previously purchased Coaching Container, hereinafter referred to as the "Client,"

DESCRIPTION OF SERVICES:

The Coach agrees to provide the following services to the Client:

• 1x Intake Form
• 1x Recorded, personal coaching video, created and recorded by Coach in alignment with Client submitted intake form, of a minimum of 20 minutes long
• 3 days of 1:1 Direct Messaging Coaching via the app 'Telegram', with a minimum of one response from Coach per day
• Mindset and Life Coaching services via practices that serve the client in their ‘Joy Evolution Mentorship’

PAYMENT TERMS:

• Client agrees to pay the Coach a total fee of £111 as agreed upon sign up and transaction, in exchange for this coaching program only
• Client shall select a payment plan between the designated options (e.g., one-time payment, monthly instalments, past-purchase discount, etc. where appropriate) and make payments according to the payment schedule provided by the Coach
• Late Payment: In the event of late payment, Client has 7 days to rectify the late payment, after which the Coach shall charge a late penalty of 5% (five percent) on the outstanding balance

CANCELLATION AND REFUND POLICY:

• Upon execution of this Agreement, Client shall be responsible for the full amount of the Fee once past the two week cooling off period
• If the Client cancels attendance to the coaching program for any reason whatsoever, the Client will receive no refund of any amount

TERMINATION:

There is a 14-day cancellation period during which all fees are refundable other than a deposit equal to the amount of the first instalment of the longest payment plan available. The cancellation period begins on the day Coach receives the deposit from Client. For any cancellation to apply the Client must give Coach notice via email to keziah@anxioustosing.com with the email subject of “Cancellation”. Outside of the 14-day cancellation period all fees remain due and are nonrefundable. Any complaints relating to the Program must be made in writing to keziah@anxioustosing.com with the email subject of “Complaint”.

LEGAL:

Coach offers no guarantee and cannot be liable to the Client, or any third party, for damages including lost profits, or consequential/special damages, even if advised of them. If any provision of this contract shall be ruled unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.

COPYRIGHT:

Client will own the copyright for all material created under this agreement, and Coach can sample and reuse only with consent from Client. Copyright in all other materials provided by Coach or created during the Program remain the intellectual property of the Coach or relevant third party owner.

INTELLECTUAL PROPERTY RIGHTS:

The Client agrees not to copy, plagiarise, or steal any documents, information, coaching concepts, audio files, videos, or trainings from the Coach or KG Anxious to Sing. Client agrees that any testimonials provided by Client will be made public and used for marketing purposes.

DATA PROTECTION:

Client agrees that information will be held as confidential unless Client agrees otherwise, in writing, except as required by law. Client agrees that Program discussion topics may be anonymously and hypothetically shared by Coach with other coaching professionals or clients for training, educational or consultation purposes, and that Coach will ensure to change any identifiable details to protect the privacy and personal data of Client.



 
ACCEPTANCE OF TERMS:

By using the services provided by the Coach, the Client acknowledges that they have read, understood, and agree to the terms and conditions of this Agreement.
